Terms and Conditions: Architectural Illustration Projects

​These terms and conditions will apply to all projects undertaken by 3D Model Perspectives (“we” or “us”) for a client (“you”) unless varied in writing for specific projects. 

3D Model Perspectives will endeavour to operate in a fair and reasonable manner at all times and it is part of our ethos to ensure we maintain a great relationship with our clients. It is, however, important to agree to certain contractual aspects in order to protect both parties. By undertaking a project with 3D Model Perspectives, you are agreeing to the following terms and conditions.

1. RELATIONSHIP OF THE PARTIES
The parties intend that an independent contractor relationship will be created by this contract, and that no partnership, joint venture or employee/employer relationship is intended or implied. “3D Model Perspectives” is the trading name of a business owned by Marina Phillips of Rangiora, New Zealand. 

2. PROJECT PROCESS
3D Model Perspectives cannot always guarantee to start work immediately on a project but will arrange a date with you as to when work can commence. The project will be run according to 3D Model Perspectives’s Project Process. 

• We will not start work before you have supplied the following:
  • Instructions or other description of the required output;
  • A 3d model or other CAD file of the subject to be illustrated.
• When the illustrations are complete, we will issue a draft for your review
  • You agree to provide prompt feedback, comment and, when appropriate, approval of the images.
  • You agree that the draft/preview images will not be used in any paper / online marketing or publication you issue, and nor will they be shared with any other party. When the feedback and approval process is complete, we will release a final high quality rendering of the image/s by placing them on a secure on-line download location from where you may download and copy the images for your own use. 
• 3D Model Perspectives will invoice the client for the amount due on the last working day of the month in which the work was completed.

3. COPYRIGHT
All material, both text and images, supplied by the client and used in the construction of the client’s design project, will remain the client’s property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.

The copyright for all material provided by 3D Model Perspectives, such as renderings, graphics, photographs and text will remain the property of 3D Model Perspectives until such time as 3D Model Perspectives receives full payment, whereupon they will become the property of the client.

4. Good and Services Tax
All prices are quoted exclusive of GST. 

5. TERMS OF PAYMENT
3D Model Perspectives requires payment within normal commercial terms by the 20th day of the month following the month the project is completed. In the case of non-payment of invoices, you are liable for all collection costs, including any actual solicitor’s fees or debt collection agency fees until the debt is paid in full.

6. TERM OF THE AGREEMENT
This agreement will apply to all projects we undertake for you unless other terms are agreed in writing. Either party may terminate this agreement on 7 working days’ written notice to the other party.
3D Model Perspectives reserves the right to cease immediately without liability to provide the service and to terminate this agreement if you should go into liquidation or bankruptcy, or if you fail to meet any obligation in accordance with this agreement.

If at any point during a project, a client wishes to cancel or is found to use the drafts/previews before the HD finals are complete, they may do so but will be invoiced an amount that 3D Model Perspectives judges to be proportional to the amount of work completed on the project up to the date of cancellation.

7. LIABILITIES
3D Model Perspectives will not accept liability for any loss or damage however caused which may be suffered or incurred or which may arise directly or indirectly with a provided service.

8. APPLICABLE LAW
Given that we understand that you acquire or hold yourself out as acquiring our services for the purpose of a business, then you agree that the provisions of the Consumers Guarantee Act 1993 will not apply to our service or the provision of any other services to you.
This agreement shall be deemed to be an agreement made in New Zealand and shall be subject to, governed by and interpreted in accordance with the laws of New Zealand.
